Shop Manhattan Style
terms and conditions
Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgment of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.
1.1. The Manhattan Ice-Tea Shop Manhattan Style Competition (“Competition“) is being run by Clover S.A Proprietary Limited, Registration Number 1994/001064/07 (“Organiser/we/us/our”).
1.2. Each person entering the Competition (“participants/entrants/you/your”) and/or accepting any prize in terms of this Competition, agrees and accepts that the Competition rules as set out in these terms and conditions (“Rules”) is binding on him or her.
1.3 Copies of these Rules are available online at www.clover.co.za (“the Website”) or at Clover Park, 200 Constantia Drive, Constantia Kloof.
2. COMPETITION PERIOD
2.1. The Competition commences at 00:01 on 1 March 2019 and will close at 23:59 on 31 May 2019 (“Competition Period”). No entries received after the end of the Competition Period will be considered.
3. WHO CAN ENTER
3.1. In order to be eligible to enter the Competition you must
3.1.1 be a legal, permanent resident of the Republic of South Africa;
3.1.2 be in possession of a valid identity document with a 13 (thirteen) digit identity number;
3.1.3 be 18 (eighteen) years old or older on the date you enter or, if you are younger than 18 (eighteen) years of age, you must be assisted to the extent necessary by a parent/legal guardian;
3.1.4 be a natural person; and
3.1.5 not be barred or disqualified by any authority from taking delivery and transfer of the Prize or any portion thereof.
3.2 .Notwithstanding clause 3.1, you are not eligible to enter this Competition if:
3.2.1 you are a director, member, partner, employee, agent or consultant of the Organisers, or any other person who directly or indirectly controls or is controlled by the Organisers;
3.2.2 you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.2.3 you are a supplier of goods or services in connection with the Competition.
4. HOW TO ENTER – MOBILE
4.1. Purchase a promotional pack of Manhattan Ice-Tea (“the Product”);
4.2. From your mobile phone, dial the USSD (Unstructured Supplementary Service Data) code *120*440*uniquecode# as stipulated on the Product, that was purchased by you.
4.3. You may enter the Competition as many times as you like, provided you use a unique Product code inside the pack or barcode number for each entry. (e. One entry per Product purchased).
4.4. You must be able to produce a valid till slip as proof of purchasing the Product may be required by the Organisers.
4.5. Each entry will be charged at 20c (twenty cents) per 20 (twenty) seconds. Free minutes do not apply. Cost of each entry will however not exceed R1.50 (one rand and fifty cents) in total.
4.6. For every 75 Manhattan Dollars earned, the individual is placed in the draw to win one of 5 shopping sprees valued at R100,000 (One Hundred Thousand Rand) each
5. HOW TO ENTER – ONLINE
5.1. Purchase a promotional pack of Manhattan Ice-Tea (“the Product”);
5.2. From a browser enabled device consumers must visit the following site: www.shopmanhattanstyle.co.za.
5.3. Once the site has loaded in the preferred browser, consumers wishing to enter the promotion must first register on the site.
5.4. By clicking on the “registration” button and completing the required information accurately a profile will be created once the save / register button is selected.
5.5. It is imperative that all details captured are accurate, especially the address fields. The purpose of the address fields are to ensure accurate delivery of the items purchased through the online store.
5.6. Consumers will be issued with a username and password, the purposes of which will be to ensure access is granted during the online shopping period. Consumers are urged to keep their site credentials safe and secure, as sharing these details could see their accumulated currency being spent without their knowledge. The organisers are not responsible for the loss of login details and the subsequent loss of accumulated currency which may occur.
5.7. Upon successful completion of the registration process, sit visitors are enabled to enter the unique code as found on their product and redeem it. The result of which will be the accumulation of a defined set of Manhattan Dollars based on the product purchased.
5.8. You may enter the Competition as many times as you like, provided you use a unique Product code inside the pack or barcode number for each entry. (e. One entry per Product purchased)
5.9. You must be able to produce a valid till slip as proof of purchasing the Product may be required by the Organisers.
5.10. The cost incurred of any data during the time spent on the promotional web site is for the account of the consumer entering the promotion and/or the individual browsing the site.
5.11. For every 75 Manhattan Dollars earned, the individual is placed in the draw to win one of 5 shopping sprees valued at R100,000 (One Hundred Thousand Rand) each
6. ACCUMULATION OF MANHATTAN DOLLARS – MOBILE / ONLINE
6.1. Every valid unique code entered via the USSD string i.e. *120*440*uniquecode#, earns the individual submitting it a defined amount of a currency known as “Manhattan Dollars”.
6.2. The purpose of accumulating the currency (“Manhattan Dollars”) is to provide consumers with the ability to purchase items online. The items are defined as part of the prize pool.
6.3. There is a set amount of Manhattan Dollars allocated per valid entry i.e. consumers who submit valid unique codes from 500ml Manhattan Ice-Tea bottles will receive 20 Manhattan Dollars. Similarly, consumers who submit unique codes from 1.5ml Manhattan Ice-Tea bottles will receive 30 Manhattan Dollars.
6.4. Entrants may accumulate as much of the afore mentioned currency as they would like.
6.5. The Manhattan Dollars are not transferrable for cash and can only be used in the context of making a purchase within the online store.
6.6. The balance of accumulated Manhattan Dollars can be viewed on the promotional website post user registration. Balances will also be submitted to consumers prior to the promotional online store being opened.
7. HOW TO SHOP – SPEND THE MANHATTAN DOLLARS
7.1. The online store (shopmanhattanstyle.co.za) will be available for consumers to check their Manhattan Dollar balances from the 01 March 2019.
7.2. The online store (shopmanhattanstyle.co.za) will be available for two shopping windows i.e.
7.2.1. From 24th April 2019 until the 26th April 2019 (Window #1)

7.3. Only consumers who have registered on the promotional website will be eligible to shop during these periods.
7.4. Consumers are not permitted to spend more than the currency they have available to them.
7.5. Manhattan Dollars which are not used will during Window #1 will be available for use during Window #2. Manhattan Dollars which remain at the end of Window #2 will be forfeited.
7.6. A finite number of prizes exists within the online store, unused currency is forfeited. Consumers are urged to login to the website during the available shopping windows and attempt to purchase their desired items as quickly as possible.
7.7. Purchasing available prize items, is on a first come – first serve basis with no exceptions.

8.2. Images of prize items hosted within the online store (shopmanhattanstyle.co.za) may differ to the prizes distributed to the consumers who have successfully purchased them.
8.3. Prize items themselves may differ to prizes distributed to the consumers who have successfully purchased them based on stock and availability.
8.4. Prizes are strictly allocated on a first come, first serve basis. The organiser is in no way responsible for circumstances, technical or otherwise, which may effect the consumer / participants reservation of any of the above mentioned prize items.
9. DELIVERY OF PURCHASED ITEMS
9.1. At the end of each day within the afore mentioned window periods, a list of purchased items per consumer will be interrogated and arrangements made to ensure that consumers are given their purchased goods.
9.2. Accuracy of the delivery address within the online registration period is critical for this purpose. Should a consumer have supplied an inaccurate delivery / shipping address the Organiser is not responsible for correcting this error and will not be held responsible for items not reaching the consumer.
9.3. Once a consumer has concluded the reservation of online items and ended the online session – the consumer will be able to amend their delivery / shipping address by emailing support at email@example.com with the subject line: “Manhattan Shipping Address”. Please note that updates of this nature can only occur once a consumer has selected their items and ended the online session and not before. It is critical to reaffirm that the delivery / shipping address captured in the registration process is critical in terms of it’s accuracy.
9.4. Consumers must give organisers a minimum of 2 weeks from date of online purchase to ensure delivery is affected.
10. GRAND PRIZE/S
10.1 For every 75 Manhattan Dollars earned, a consumer is placed into the draw to win one of 5 x R100,000 only (One Hundred Thousand Rand) shopping sprees.
10.2 All of the 5 winners of the R100,000 only (One Hundred Thousand Rand) shopping sprees must be available between the 27th & 28th June 2019. Should the organisers be requested to contact the employers of any of the winners to substantiate the pending events, then they will assist.
10.3 The R100,000 shopping experience will cover all reasonable travel (flight & car), accommodation, meal vouchers, spa treatment as well as the shopping spree costs.
10.4 Shopping spree cost breakdown;
10.4.1 Flights, vehicle hire, transfers and accommodation: R26,000
10.4.2 Meal & Spa vouchers: R4000
10.4.3 Shopping spree: R70,000
10.5. Winners may ask a friend or family member to join them for the shopping spree experience, however the expenses associated with this request will be deducted from the R100,000 shopping experience.
10.6. All travelling arrangements and bookings will be managed by Clover and are not transferable for cash.
10.7. Adjustments in prize allocation costs can be amended depending on winner’s place of residence (example: if they live in Johannesburg, their transport and accommodation costs will be lower and their shopping spree allocation will be higher)
10.8. Winners need to make themselves available on both the 27th and 28th June 2019. The 27th June 2019 will be utilised as a period to scout / plan the shopping experience, with the 28th June 2019 being the day of the actual shopping sprees.
10.9. Winners must agree to be filmed for post campaign highlights content.
10.10. Winners must agree to being featured in social media content posts.
10.11. Winners cannot deviate from the location specified by the Organisers as to where the R100,000 (One Hundred Thousand Rand) can be spent.
10.12. Any amount, from the awarded R100,000 (One Hundred Thousand Rand), that is unused, will be forfeited.
10.13. The Organisers are not responsible for the transportation of the goods purchased during the shopping exercise.
10.14. The Organisers are not responsible for the condition of, or return of any goods which, upon review may be deemed unwanted by the prize winner/s.
10.15. The Organisers for any insurance requirements which may accompany any of the goods purchased.
11. GENERAL TERMS
11.1 The Organiser may in its sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised Rules on the Website.
11.2. The Organiser will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time should it be deemed necessary ion the sole and unfettered discretion of the Organisers.
11.3. If you are not eligible to enter the Competition in terms of clause 3 above, you will forfeit any prize that may be allocated to you in terms of this Competition. The Organisers reserve the right to request you to provide necessary proof that you have met the eligibility requirements. Should you fail to provide such proof within a reasonable time, you will be disqualified and any prizes will be forfeited and returned if applicable.
11.4. The Organiser may collect, store and use any personal information of entrants and/or other participants for communication or statistical purposes. By entering the Competition, you expressly consent to the aforesaid use.
11.5. IN THE EVENT OF A DISPUTE, THE DECISION OF THE ORGANISER WILL BE FINAL AND BINDING AND NO CORRESPONDENCE WILL BE ENTERED INTO. IN THIS REGARD AND FOR FURTHER CLARITY, THE ORGANISER SHALL BE ENTITLED TO DEAL WITH SUCH DISPUTES (OR ANY FAILURE BY PARTICIPANTS TO FOLLOW THE RULES) IN THEIR SOLE DISCRETION, INCLUDING THAT THE ORGANISER SHALL BE ENTITLED, IN ADDITION TO ANY OTHER RIGHTS WHICH THE ORGANISER MAY HAVE IN TERMS OF THESE RULES AND/OR THE GENERAL COMPETITION RULES, TO IMMEDIATELY DISQUALIFY PARTICIPANTS FROM THIS COMPETITION.
11.6. BY ENTERING THE COMPETITION AND/OR ACCEPTING ANY PRIZE, THE ENTRANTS, USERS AND/OR WINNERS HEREBY INDEMNIFY, RELEASE AND HOLD HARMLESS THE ORGANISER (INCLUDING ITS SUBSIDIARIES, HOLDING COMPANIES AND AFFILIATES), ITS DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS AND CONTRACTORS (THE “ORGANISER PARTIES”) FROM AND AGAINST ANY ACTIONS, CLAIMS AND/OR LIABILITY FOR INJURY, LOSS, DAMAGE, EXPENSE, CLAIM OR DAMAGES OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THE COMPETITION, AND/OR THE USE, ACCEPTANCE OR POSSESSION OF A PRIZE, AND/OR PARTICIPATION (OR NON-PARTICIPATION) IN A PRIZE-RELATED ACTIVITY.
11.7. THE ORGANISER RESERVES THE RIGHT TO TERMINATE THE COMPETITION AT ANY TIME WITH IMMEDIATE EFFECT. IF THIS IS THE CASE, THE ORGANISER WILL PROVIDE A NOTICE ON THE WEBSITE. IT SHALL BE THE RESPONSIBILITY OF ENTRANTS TO REVIEW SUCH WEBSITE IN THIS RESPECT. IN SUCH EVENT, ALL ENTRANTS HEREBY WAIVE ANY RIGHTS WHICH THEY MAY HAVE AGAINST ANY OF THE ORGANISER PARTIES AND ACKNOWLEDGE THAT THEY WILL HAVE NO RECOURSE OR CLAIM OF ANY NATURE AGAINST THE ORGANISER PARTIES
11.8. THE ORGANISER IS NOT LIABLE FOR ANY TECHNICAL FAILURE THAT MAY RESULT IN AN ENTRY NOT BEING SUCCESSFULLY SUBMITTED.
11.9. ANY PRIZE IS ACCEPTED BY A WINNER AT HIS/HER OWN RISK AND THE ORGANISER IS NOT LIABLE, AT ANY TIME, FOR ANY DEFECT IN THE PRIZE.
11.10. Where relevant, if a Winner does not accept the Prize as required herein, if an entry is not valid for whatever reason, if a Winner has breached these terms and conditions, if a Winner renounces the Prize or we deem such Winner to have renounced the Prize, we reserve the right to declare the Prize forfeited and/or choose a new Winner.
11.11. Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrants or the organisers in terms of the Consumer Protection Act, 68 of 2008.
11.12. The duration of this Competition may also be extended or curtailed at the sole discretion of the Organiser. If this is the case, the Organiser will provide notice of this on the Website.
